Deceased DNA Testing

Paternity For Life can facilitate DNA testing using forensic samples collected from deceased individuals, in the event of post mortem paternity disputes or claims.

Under the Human Tissue Act 2004, DNA is considered a ‘designated material’ and as such, DNA material can only be collected from the deceased by an authorised person in a HTA licensed premises. Forensic samplers must have the permission of the HTA licence holder and/or the Coroner. Chapels of rest and funeral directors are not HTA licensed. Therefore, samples can only legally be obtained from HTA licensed mortuaries or hospitals. Taking designated material from unlicensed premises may constitute an offence.

Prior to commencing testing, you will need to establish whether a sample is available from the deceased party, and written consent from the next of kin must be in place before testing can proceed.
